A Model of Developing the Mediators by Buddhist Peaceful Means : A Case Study of Chonburi Court

Abstract

 

This dissertation is of 3 objectives: (1) to study problems and difficulties of dispute mediators of Chonburi Court, (2) to study the means of developing potential of dispute mediators and Buddhadhamma promoting mediators’ potential, and (3) to present A Model of Developing Dispute Mediators of Chonburi Court by Buddhist Peaceful Means; it is in the form of Qualitative Field Research by letting volunteers who have more than 3 year experience to be part of dispute mediators, plus studying from documents and various researches, and an in-depth interview of 28  key informants, gathering information to analyze, and bring the key performance indicators and the received information to synthesize for creating a model of developing dispute mediators by proper Buddhadhamma that is deserved to develop as a complete development in every dimension both external and internal in accordance with the principle of Bhāvanā or the Cultivation.

From the research, it is found the followings:

1. From studying problems and difficulties of dispute mediators of Chonburi Court, it is found that some parts of dispute mediators overlook the important factor of development which the received information is from Office of Judicial Affairs of Court of Justice under each one’s confidence and long-time experience in performing duties with both qualification and seniority, knowledge and efficacy, exceedingly, some mediators are used to be in high executive position prior to perform the mission of dispute mediation.  Accordingly, it is hard to accept theories of the modern process of developing potentiality, yet they officiate under the law which aims at the key case performance rather aiming at social peace; it still lacks of using the important tool in self-developing all through the application of Dhamma to self-development for perfectly complete virtue.

2. From studying the means of developing potential of dispute mediators and Buddhadhamma promoting mediators’ potential, the researcher found and agree that the Principle of Bhāvanā or Cultivation should be brought to use as a conceptual framework in developing throughout the aim at collecting information for analyzing and synthesizing; it is found that there are 3 phases in developing mediators; and the highest Dhamma that promotes and is proper to the development of mediators’ internal potential is Ariyavạḍḍhi or noble growth, one of seven Sappurisadhamma Principle which is the representing part of development that is  suitable for the one who is bringing to further potentiality, and is depended to the desire of that mediator as the core.

3. Presenting A Model of Developing Dispute Mediators of Chonburi Court by Buddhist Peaceful Means: the outcome of the analysis is brought to form a model for developing dispute mediators in 4 aspects that the researcher uses the Principle of Bhāvanā or Cultivation as the conceptual framework of the research means; the model the researcher creates has 7 stage process, i.e. 1) developing mediators to have positive attitudes, 2) training for being deep-listening listeners, 3) putting the principle of Bhāvanā or Cultivation as the frame in developing fully 4 aspects, 4) creating motivation for eagerness in studying for more knowledge, 5) enhancing for being volunteers, 6) in every phase of developing self-potential and other involved persons’, Sappurisadhamma Principle should be completely used as the representing part, and 7) aiming at the mainly important target of leading society to be rich in peace.
